The action was brought by Roy Edwards and his compensation carrier against Cutler-Hammer, Inc. and C. F. Eschweiler and T.
L. Eschweiler, to recover damages for personal injuries. Each defendant answered the complaint denying liability and entered a cross-complaint against the other for contribution
if held liable. The case was tried to court and jury. A special verdict was rendered in which it was found that Harold J.
Kiefert, the employee of Cutler-Hammer was causally negligent, and that Roy Edwards, the plaintiff, was not negligent as to
the exercise of ordinary care for his own safety.
